Cyber Security and Privacy Liability

Cyber liability is one of the fastest growing areas of risk, and the engineering profession is not immune. Cyber Liability Coverage is available to participants in the OSPE Professional Liability Insurance program. There are two (2) levels of coverage to choose from.

1 - The Cyber extension on the professional liability insurance policy includes:

  • Limit of $50,000
  • The content of the insured’s computer systems, website or additions made by a hacker due to:
  • Your unintentional infringement of any intellectual property;
  • Your unintentional breach of privacy;
  • Or a security breach;
  • Your negligent transmission of a computer virus, worm, logic bomb or Trojan horse to anyone with whom they transact business or who uses their website in the course of their business;
  • Your unauthorized collection or misuse of customer data which is held electronically.

First Party Hacker Damage is also included. This means that insurers will pay the reasonable and necessary costs and expenses that the insured incurs if a hacker damages, destroys or alters your website or computer system.

Coverage is also provided for Advertising Expenses that you may incur after a Cyber claim is made under the policy. For example, insurers will pay the reasonable and necessary costs and expenses that the insured incurs in order to notify their customers of a data breach as well as for public relations services to mitigate any reputational damage resulting from the breach.

2 - Stand-Alone Cyber Security and Privacy Liability Insurance includes:

  • Limit of $1,000,000
  • All coverages noted above
  • Claims expenses
  • Business Interruption
  • Fines and Penalties
  • Data Protection Loss
  • Forensic Expenses
  • And more
